GENERAL

(hereinafter referred to as “you”) with ITO FOLCH of London, United Kingdom, (“ITO FOLCH”, “we”, “us”, “our”)
(“ITO FOLCH”, “we”, “us”, “our”) through our website or app (“Platform”).
2. These Purchase Terms incorporates our Website Terms and Conditions
as well as and any other policies, rules or documents referred to herein
(including our Privacy Policy).
3. By placing an order, you agree to be bound by these Purchase Terms
and to enter in a contract with us and with the relevant creator of the
design included in the product purchased by you.
4. Please ensure that you have read and understood our Purchase Terms
before placing an order on the Platform.
5. The inclusion of any products on the Platform at a particular time does
not imply or warrant that these products will be available at any time.
We reserve the right to discontinue any product at any time.
6. We reserve the right to amend these Terms from time to time without
prior notice to you.
YOUR ORDER
1. Our acceptance of your order will take place with a confirmation email
which will be sent to the e-mail address provided by you. At that point,
a binding agreement will come into existence between you and us and
we will send you another email concerning the delivery of the ordered
product.
2. We will assign an order number to your order and tell you what it is
when we accept your order.
3. We will endeavour to dispatch your order as quickly as possible,
Monday-Friday excluding public holidays. Orders placed after 12pm
GMT/BST may not be processed until the next working day.
4. All prices displayed on the Platform include VAT where applicable.
Orders dispatched to a UK address will have VAT included. Orders
shipped overseas will not be charged VAT at the point of sale. Please
note that all overseas customers will be responsible for any import fees,
duties and taxes applicable in the destination country.
THE PRODUCTS

only. Your product may vary slightly from those images.
2. The packaging of products may vary from that shown on images on the

SHIPPING AND DELIVERY
1. Please note that there is an estimated manufacturing time of 2-4 days
for each order. This duration allows us to meticulously craft and
customisecustomize your ITO FOLCH product to ensure its exceptional quality.
2. The shipping transit time may vary depending on your location. We
work with reliable shipping partners to deliver your order as efficiently
as possible. However, please consider that transit times may be subject
to external factors beyond our control, such as customs procedures or
unforeseen delays in transportation.
3. ITO FOLCH products are shipped directly from our workshops situated across
the globe. This global distribution network enables us to deliver our
unique creations to customers worldwide. For specific details regarding
shipping locations, please contact us.
4. The shipping costs will be calculated and displayed during the
checkout process, based on your delivery address and the weight of the
product(s) in your order. Please review the shipping costs before
finalisingfinalizing your purchase.
5. Please be aware that import duties, taxes, and any other fees or
charges imposed by customs authorities are the sole responsibility of
the recipient. These charges may vary depending on your country of
residence and the value of your order. We advise you to consult with
your local customs office for further information on applicable duties
and taxes.
6. In some cases, specific products or materials may be subject to
shipping restrictions or regulations imposed by certain countries or
regions. ITO FOLCH reserves the right to inform customers of any such
limitations or to modify shipping options accordingly.
RETURN AND DEFECTIVE PRODUCTS
1. We solely accept returns under the circumstances of a defective
product. Our commitment lies in delivering the highest quality products,
and we are determined to address any issues that may arise.
2. In the unlikely event that you receive a defective product, we are more
than pleased to rectify the situation. Should you believe you have
received a defective product, we kindly request that you promptly
contact our customer support team at [email protected]. We greatly
appreciate your cooperation in promptly notifying us of any issues, as it
allows us to swiftly address the matter.
3. Our customer support team is fully committed to resolving any
concerns you may have. Upon notifying us of the defective product, our
team will promptly assist you in finding a satisfactory solution, which
may include arranging for a replacement product to be dispatched to
you.
4. ITO FOLCH’s production process begins immediately upon receiving an order.
If you need to cancel your order, please notify us by emailing
[email protected] within 2 hours of placing the order. If you do not cancel
within this time frame, we regret that we will be unable to
accommodate your request as your item will already be
in production.
PAYMENT
1. The following type of payment will be accepted on the Platform:
Payment processing:Your credit card / PayPal (or other payment platform) account will be debited once your order has been placed, in order to reserve your item(s).
LIABILITY
1. Nothing in these Terms shall exclude or limit our liability with regard to
any matter for which it would be unlawful for us to limit or exclude our
liability.
2. If we breach these Purchase Terms, we shall only be liable for losses
which are a reasonably foreseeable consequence of such breach.
3. We are not responsible for indirect losses that which are a side effect of
the main loss or damage, for example loss of profits or loss of
opportunity; or for failure to deliver the goods or to meet any of our
other obligations under these Purchase Terms where such failure is due
to an event that is beyond our reasonable control, which includes but is
not limited to fire, flood, storm, riot, civil disturbance, war, nuclear
accident and terrorist activity.
4. Our maximum liability to you for any loss or damage arising in
connection with your order on the Platform shall be limited to the total
price of your order.
APPLICABLE LAW
1. The laws of England and Wales will apply to our Purchase Terms and
Conditions and in particular the provisions established in the Consumer
Rights Act 2015 will apply. The courts of Barcelona will have
exclusive jurisdiction over any claim relating to the purchase of any
products on the Platform.
